10 more men allege sexual misconduct by Bomba, intend to litigate

10 additional former Indiana men's basketball players have made allegations of sexual misconduct by former team physician Brad Bomba Sr and intend to pursue litigation, as reported Tuesday by ESPN. 

Last fall, former players Haris Mujezinovic and Charlie Miller alleged that they were “subjected to inappropriate prostate and rectal exams during annual physicals with Dr. Bomba Sr.” Mujezinovic played for Indiana from 1995-1997, and Miller from 1994-1998. 

The two players retained attorney Kathleen Delaney to file a suit against IU, saying they “systemically mishandled” players’ complaints of sexual misconduct. The suit was later amended and now additionally names former head men’s basketball trainer Tim Garl – who parted ways with Indiana in March – as defendants. The plaintiffs allege that Garl and other university officials – including coach Bob Knight – were aware of Bomba Sr.’s misconduct and did not stop it. 

Three more players have since joined the suit, bringing the total to five.

In a December 4 deposition, Bomba Sr. invoked his Fifth Amendment right against self-incrimination 45 times. Bomba Sr. passed away in May, complicating the legal path forward. 

Last month, a Jones Day investigation concluded that Bomba Sr acted in a “clinically appropriate manner.” Since the investigation began, the total number of players who have made allegations has risen to at least 15. 

Michelle Simpson Tuegel, who also litigated the case against former Michigan State gymnastics coach Larry Nassar, represents the 10 new players alleging misconduct. 

“I’m proud to represent ten incredibly brave clients who have come forward to tell their stories and be part of seeking the justice Indiana University has owed them for decades,” Simpson Tuegel wrote in an X post.
