A federal judge dismissed a negligence lawsuit Monday against one of the three men seen with missing IU student Lauren Spierer before she disappeared in June 2011.
Judge Tanya Walton Pratt granted the motion to dismiss the complaint against Mike Beth. Judge Walton Pratt’s office confirmed Rob and Charlene Spierer, Lauren’s parents, were present for the hearing.
Spierer, who has yet to be located following exhaustive searches the past two years, was a 20-year-old IU sophomore at the time of her disappearance on June 3, 2011.
The Spierers allege in their complaint filed May 31 that three men — all seen with their daughter at one point on June 3, 2011 — abandoned “duty of care” for Spierer when she was in an inebriated state and let her leave the apartment complex where the men lived.
The cases against the two other men, Corey Rossman and Jay Rosenbaum, who were also with Spierer on June 3, 2011, could be decided in coming weeks.
That night, during the early morning hours of June 3, Lauren attended a party at
Rosenbaum’s residence where she consumed alcohol. Following the party, Lauren and Rossman returned to Rossman’s residence in the same complex, according to court documents. Beth lived with Rossman at the time.
Beth took notice that Spierer was “extremely intoxicated.”
“I want to have three more drinks, and then I’ll be feeling good,” Rossman told Beth, according to court documents.
Rossman and Spierer proceeded to Kilroy’s Sports Bar where he “helped Spierer consume multiple alcoholic beverages” in a span of about an hour.
After leaving the bar, where Spierer left behind her shoes and cellphone, the two ultimately returned to Rossman’s residence after stopping by Spierer’s apartment complex, but never making it to her actual residence.
Rossman was seen with an incapacitated Spierer “slung across his back” as he carried her to his apartment. Beth returned from Rosenbaum’s shortly thereafter and advised that Spierer remain at their apartment for the night. Beth took Spierer to Rosenbaum’s apartment, according to court documents, where Rosenbaum attempted to contact mutual friends to retrieve Spierer.
Beth then left Rosenbaum’s apartment and returned to his own. Rosenbaum later reported that Spierer was last seen leaving his apartment at about 4:30 a.m. on June 3, 2011, walking toward 11th Street and College Avenue.
