Customer shoots Indianapolis gun shop employee

Don’s Guns and Galleries employee Benjamin Chance remains in the hospital suffering from complications after he was shot while working at the Indianapolis firearms store Sept. 17.

Chance will undergo surgery Thursday and will remain hospitalized for at least another week, his doctor told WISHTV.

No charges will be filed against Chance, 42, for shooting and killing a customer, a Marion County Prosecutor’s Office spokesperson told the Indianapolis Star. The prosecutor’s office determined Chance acted in self-defense when he shot and killed customer Brian Wayner after Wayner allegedly opened fire at Don’s Guns and Galleries, located at 3807 Lafayette Road in Indianapolis.

Gun store owner Don Davis told the Indianapolis Star that Wayner was renting a .40-caliber handgun. As Chance rang up his bill, Wayner fired three shots at Chance, striking him once in the chest.

Chance fired back at Wayner, also using a .40-caliber handgun, according to the Indianapolis Star.

Wayner died of multiple gunshot wounds.
