Police arrested the driver who caused a fatal car crash Nov. 9 upon his release from Bloomington Hospital Tuesday.\nBryan M. Gooldy, 45, the driver of the car that killed IU alumna Katharine B. Comiskey, will make an appearance in Monroe County Court at 2:30 p.m. today, said Bloomington Police Department Cpt. Joe Qualters in a press release.\nComiskey, an English teacher at Indian Creek High School in Trafalgar, Ind., was killed in a head-on collision when Gooldy crossed the center line on North Walnut Street, hitting her car.\n"Gooldy was released from Bloomington Hospital at approximately 11:15 a.m. this morning and taken into custody at the hospital by Bloomington Police," Qualters said Tuesday. "He was booked into the Monroe County Jail at approximately 12:07 p.m on charges of operating a vehicle while intoxicated causing death, a Class B Felony; operating a vehicle while under the influence of drugs causing death, a Class B Felony; and (being a) habitual offender."\nJim Trulock, the BPD chief deputy who filed the charges against Gooldy, did not return calls by press time.\nGooldy had previously been charged with possession of a controlled substance in 1994, obtaining a controlled substance by fraud in 1995 and robbery in 2000, according to the statement.\nToxicology reports released on Nov. 10 found traces of several drugs in Gooldy's system at the time of the accident, according to police reports.\n"Test results on the blood sample indicated the presence of opiates, cocaine and benzodiazepine," stated a press release from BPD. "The (probable cause) affidavit alleges that Gooldy caused the death of Katharine B. Comiskey by operating a vehicle under the influence of these substances at the time of the accident."\nAccording to Indiana Code 35-50-2-5, "A person who commits a class B felony, shall be imprisoned for a fixed term of 10 years, with not more then 10 years added for aggravating circumstances or not more then four years subtracted for mitigating circumstances." A fine of up to $10,000 can also be assessed, according to the law.\nQualters said the total sentence length depends on what charges the prosecutor seeks and what the judge and the jury ultimately decide. \n"There might be conditions under which you can only be convicted of one (charge)," he said.\nBond for Gooldy has been set in the amount of $1 million.
