BREAKING: Judge denies NCAA’s motion to dismiss Louis Moore case

Judge Dale Tillery of the Dallas County 134th Civil District Court denied the NCAA’s motion to dismiss Indiana safety Louis Moore’s eligibility lawsuit during a hearing Wednesday. 

Michael Niziolek of the Herald-Times first reported the denial on X. 

Following a special appearance from NCAA attorney Taylor Askew, the NCAA has continually argued the Dallas court did not have “personal jurisdiction” and that Moore should refile in Indiana, where the NCAA is headquartered. 

Moore played at Navarro College in Corsicana, Texas, for two years before transferring to Indiana for the first time in 2022. The NCAA’s denial of his waiver for 2025-26 eligibility is an attempt to enforce a bylaw that states time spent at a junior college counts against athletes’ NCAA eligibility. 

Askew argued “there’s nothing within the facts plead that’s occurred (in Texas),” but Tillery believes that application of NCAA rules to JUCO schools in Texas impacted athletes in Moore's position. 

Arguments are underway on the merits of an injunction which, if granted, would make Moore eligible for the entire 2025 season.
