Women refuses to report rape, suspect arrested for battery

Police interviewed a 26-year-old woman being treated at IU Health Bloomington Hospital yesterday, but she refused to cooperate in a possible rape investigation.

The woman said her boyfriend, Daniel Gilbert, 25, had attacked her, but she told a Bloomington detective both at the hospital and the police station that she didn't want to file charges, Lt. Bill Parker of the Bloomington Police Department said.

However, police were able to arrest Gilbert for domestic battery. The woman had visible injuries on her face and was bleeding, Parker said.

The woman told police she and Gilbert had been drinking and decided to go to his brother's home. They and Gilbert's two children, 3 and 4 years old, were driving on State Road 37 when she and Gilbert began to fight.

The fight allegedly became physical in the vehicle, Parker said the woman reported. Gilbert allegedly began to punch her before pulling over and ordering her out of the car.

Because the children were present, the domestic battery charge is elevated to a D felony, Parker said.
