A motion filed by the attorney of Hai “Howie” Yu states that University officials suspended the former sophomore.
IU spokesman Larry MacIntyre confirmed last week that Yu “is no longer enrolled at IU,” but could not comment on the specific disciplinary procedures as a result of the Family Educational Rights and Privacy Act.
Yu, the Foster Residence Center representative to the 2009-10 IU Student Association Congress, faces felony rape and criminal confinement charges for an alleged sexual assault that took place outside of the Foster Magee residence hall March 11.
Because of FERPA, the details of Yu’s suspension are unclear. However, his attorney Joe Lozano said the former sophomore can no longer attend classes and does not live in University housing. As a condition of his bail, Yu must participate in home detention with GPS monitoring. He has been in the program since March 25 and must remain in Monroe County until his case is decided.
Tom Rhodes, director of the Monroe County Community Corrections, said individuals in the home detention program are tracked using land lines, anklet monitors and personal visits.
According to the court file, Yu must be in school or working while on home detention. However, Lozano and the court are in the process of clarifying the conditions of this detention.
A pretrial conference is scheduled for April 29.
