Deal offered in Comiskey case

Plea bargain would result in 40-year sentence

A proposed plea deal, which came up in a March 17 hearing at the Monroe County Circuit Court, would result in 40 years of jail time for Bryan "Mitch" Gooldy in exchange for pleading guilty to driving while intoxicated, causing death and being a habitual offender, according to a March 18 article in The Herald-Times. Gooldy is accused of causing the Nov. 9, 2004, car crash that killed Kate Comiskey, IU alumna and teacher at Indian Creek High School in Trafalgar, Ind.\nIt is unclear how long the deal will stay on the table, and if Gooldy takes the deal, he would receive a 50-year prison sentence, with 10 of those years suspended, according to the article.\n"We have been in negotiations, and the state indicated the offer will not be changing," said public defender Stuart Baggerly, who is representing Gooldy, according to the article.\nDuring the hearing, Baggerly told Monroe Circuit Court Judge Marc Kellams has already received health records for his client and is seeking documents from the Monroe County Probation Department, according to the article.\nBloomington Police Department reports stated Comiskey was traveling northbound on North Walnut at about 7:05 a.m. when a southbound vehicle driven by Bryan Gooldy, 45, of Bloomington, crossed the center line, resulting in a head-on collision, according to a Nov. 10, 2004, article in the Indiana Daily Student. \nAfter being transported to Bloomington Hospital, Comiskey was pronounced dead from injuries acquired from the accident.\nAccording to the article, a BPD press release stated that prior to the accident, a motorist on Indiana 37 contacted Monroe County Central Dispatch to report a vehicle weaving in and out of its lane. Officers were dispatched to locate the vehicle, which was later identified as Gooldy's, but they were not able to do so before the accident.\nAnother hearing in the case is set at 2 p.m. April 26, according to The Herald-Times article.
