Snow scuffle lands councilman in jail

MUNCIE -- A scuffle over a 4-foot-tall pile of snow a neighbor dumped on his driveway landed a city council member in jail, police said.\nCouncilman Sam Marshall's neighbor Charles Stoneburner told officers he was angry over a city plow pushing snow across his home's driveway and that he used a tractor to pile the snow in Marshall's drive.\nMarshall, who is a supervisor with the city's street department, arrived home Monday night to find the pile. He confronted Stoneburner, who told officers Marshall struck him in the head and wrestled him to the ground.\nMarshall, 55, was arrested on a preliminary charge of misdemeanor battery. He said Tuesday he would not comment on the case.\nThe scuffle happened after about 10 inches of snow had fallen on the city since Friday night.\nStoneburner, who police said suffered a minor injury to his forehead, said he plowed snow into Marshall's driveway because he was tired of the city pushing snow in his.\n"I think justice was done," Stoneburner said. "I just thought, 'How would he like if somebody plowed his driveway under?' So I went and plowed his driveway under."\nMarshall was released from jail after posting a $2,500 bond.\nThe Delaware County prosecutor's office had not yet reviewed the arrest report from police Tuesday. The battery charge is punishable by a maximum sentence of one year in jail.
