Former IU student Noah Apgar’s three-day rape trial ended after Monroe County Circuit Court Judge Valeri Haughton declared a mistrial due to a hung jury last Thursday.
Apgar was first charged with five counts of rape, one count of strangulation and one count of criminal confinement in September 2024 after two women on different days reported Apgar to Indiana University Police Department.
The two women’s cases will have separate trials, Monroe County Chief Deputy Prosecuting Attorney Jeff Kehr wrote in an email. Apgar’s trial last week was the first of two, and tried him for one count of rape. The second victim’s trial for the remaining six charges against Apgar is still awaiting a date and a judge.
Apgar pled not guilty to one count of rape in last week’s trial.
After an eight-hour deliberation, the trial’s jury was unable to reach a decision, resulting in a mistrial. A mistrial is declared when a jury cannot reach a decision after deliberations, and the defendant is not cleared of charges or declared guilty.
After a mistrial, the prosecution is given the option to retry the case, offer a plea deal or dismiss charges against Apgar. The prosecution chose to retry the case.
Apgar will be retried on Sept. 14, 2026 in Monroe Country.
