SPARC case to be heard by Supreme Court

The IU Supreme Court will have a public hearing regarding SPARC v. Election Commission at 10 p.m. Wednesday in the Sherman Minton Moot Court Room (123) in the Maurer School of Law.

The public is encouraged to attend.

According to the preliminary injunction issued by the court last Thursday, the hearing will address two main issues: whether Chair of the Election Commission Melody Mostow violated the Election Code that states she must “issue advisory opinions to any individual or body requesting interpretation of this Code” and whether the Election Code prohibits a ticket from replacing a candidate executive member.

The court will issue a decision within 48 hours of the conclusion of the hearing.

Last Thursday, SPARC was disqualified from the IU Student Association election after the SPARC candidate for Vice President of Congress, Thomas Dauer, withdrew from the race. Because SPARC had an incomplete ticket, the Election Commission disqualified them, ruling it would be “unfair” to let anyone apply to fill this vacancy post-deadline.

SPARC then filed a petition for emergency injunctive relief, which was granted by the court, allowing the ticket to participate in last week’s debate.

The hearing was scheduled once the preliminary injunction was released.
