A Bloomington man arrested for murder is claiming he was insane during the November 2011 shooting of a Pizza X employee but does not plan to cooperate with court-assigned mental health experts.
James D. Finney, 23, was expected to go on trial for the murder of Adam Sarnecki on Oct. 1, but the case has been pushed to Feb. 18.
In a pretrial hearing last Tuesday, Monroe Circuit Judge Marc Kellams reminded Finney’s lawyers that if Finney does not cooperate with court-assigned mental health experts, he is allowed only one friend or family member as a witness to testify on his behalf.
He will also be unable to call his own mental health expert to the stand.
Last week, Finney asked in a letter to Kellams to move the case out of Monroe County due to pretrial publicity. Finney’s lawyers have not decided whether or not to file a motion to have the case moved.
Finney is charged with the murder of Sarnecki, being a felon in possession of a handgun, illegal possession of a handgun, battery with a deadly weapon, burglary and criminal recklessness.
